The Federal Communications Commission (FCC) has issued a “Notice of Apparent Liability for Forfeiture” to Sennheiser Electronic Corporation for its willful and continued violation of the Communications Act of 1934. The forfeiture in the amount of $7000 arises from the company’s marketing of “unauthorized radio frequency devices”—in this case portable wireless microphones transmitting over various frequencies. The company has contended that its error was strictly a matter of paperwork and that its marketing department went on selling the devices unaware that a pending application for certification had been allowed to lapse. In seeking the full amount of the proposed forfeiture, the Commission’s Notice states “As intentional radiators, wireless microphones are required by Section 15.201 of the Rules to be approved prior to marketing though the equipment certification procedures described in Sections 2.1031 – 2.1060 of the Rules.Find the actual Notice on the FCC website.
